Trademark Hold Up

So I get a lovely email stating that my Imperial Designs name is too close to others already in use and may cause a conflict, and that I may counter with a claim that says it won’t. So I replied…

“ Likelihood of Confusion and Similarity of the Marks: This mark separates and stands alone from other mark because of many reasons. First of all, the name carries the weight of its design which plays a huge role in establishing the mark. The bold image of the proud lion are imprinted on the viewers mind as one and the same with the name and the graffiti lettering of

Imperial set it apart from the rest as a staple of urban culture. When people ask for the name brand, the way in which they ask will also carry the weight of the images descriptivequalities. Secondly, This brand is to be focused in urban areas and inner cities where the clothing reflects the culture. When the name brand is asked for, there will be no mistaking what the consumer is inquiring. The name brand represents the cultures of lifestyles of people of color, a majority of which will be African-American and Hispanic, who will be the ones asking for it in the places they tend to purchase goods and services.

Finally, this name brand’s goal is awareness and education through art and design. The concepts and ideas put forth there-in, will be of a nature to enlighten the minds of people of color to their social, economic, and political standings in todays society. Through awareness and education the name stands to invoke a sense of self will, determination, and place, as beneficial contributors to this worlds progression and betterment.

In conclusion, when people ask for this brand by name, they will not be asking for underwear, leather jackets,

or construction boots. The name denotes cultural awareness and understanding and carries that imprint, thus is clearly defined and separated from any names of similar distinctions. As is with any popular name brand, the name is carried by the strength of its purpose, and though the name is said separately from the images associated with it, branding makes the two subconsciously inseparable and unmistakeable.”….

So regardless of that well placed effort, I was still told that there is a 99.9% chance im not gonna be able to get it approved… I guess they really didnt like my answer… lol. In any event I look at such situations as an opportunity for change from a higher power… what is meant to be will be… now im just gonna go harder with another name that represents the cause… I will not be denied.
